Welcome to MoniMoni. These Terms of Service ("Terms") govern your access to and use of the MoniMoni website, mobile applications, and related products, features, and services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
1. Privacy
Please review our Privacy Policy to understand how MoniMoni handles information. The Privacy Policy is incorporated into these Terms by reference.
2. Eligibility
You must be able to form a binding agreement under the laws that apply to you. MoniMoni is not intended to provide services directly to children under the age of 14. Minors should use the Services only with the consent and guidance of a parent or legal guardian.
3. Using MoniMoni
MoniMoni lets you import, configure, and play simulator scripts and interactive story content. You are responsible for the scripts, prompts, character settings, images, API configurations, and other content you create, import, submit, or use with the Services.
You agree to use the Services only for lawful, personal, and non-commercial purposes, unless we separately agree otherwise in writing.
4. Accounts, Local Data, and API Keys
Some features may store data locally on your device or in your browser, including simulator scripts, story copies, settings, model names, API endpoints, and API keys. You are responsible for keeping your device, API keys, and access credentials secure.
If you choose to use a third-party API key or endpoint, you are responsible for your relationship with that provider, including payments, usage limits, model behavior, and compliance with that provider's terms.
5. Acceptable Use
You agree not to use the Services in a way that:
- violates any applicable law or regulation;
- infringes or violates the rights of another person or entity;
- contains or promotes unlawful, abusive, harassing, hateful, exploitative, or deceptive content;
- exploits, harms, or attempts to exploit or harm minors;
- attempts to access, collect, or use another person's private information without permission;
- interferes with, overloads, reverse engineers, scrapes, or disrupts the Services; or
- uses the Services to distribute spam, malware, or automated abuse.
6. User Content
"User Content" means anything you submit, import, upload, generate, store, or otherwise provide through the Services, including scripts, story text, prompts, character descriptions, images, feedback, and settings.
You keep ownership of your User Content. You grant MoniMoni a limited, non-exclusive license to process, display, transmit, and use User Content as needed to operate, maintain, protect, and improve the Services and to provide the features you request.
You represent that you have the necessary rights to use and submit your User Content, and that your User Content complies with these Terms and applicable law.
7. AI Features and Generated Content
MoniMoni may use AI features to parse scripts, generate options, continue stories, create messages, or otherwise support interactive gameplay. AI outputs may be inaccurate, incomplete, unexpected, or offensive. You are responsible for reviewing and deciding how to use any generated content.
We do not guarantee that AI-generated content will be accurate, suitable for your purpose, unique, or free from third-party rights.
8. Third-Party Services
The Services may link to or integrate with third-party websites, model providers, API services, app stores, payment processors, or community platforms. We do not control those third parties and are not responsible for their content, availability, security, pricing, policies, or practices.
9. Payments and Purchases
MoniMoni may offer paid features, subscriptions, in-app purchases, or paid access in the future. Payment terms shown at the time of purchase will become part of these Terms. App store purchases, refunds, billing, and cancellations may be handled by the relevant app store or payment provider under its own terms.
Third-party API usage fees, token costs, subscriptions, or credits are charged by the relevant provider and are not controlled by MoniMoni unless expressly stated.
10. Changes to the Services or Terms
We may update, suspend, discontinue, or change any part of the Services at any time. We may also update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms in the App or on our website. Continued use of the Services after changes become effective means you accept the updated Terms.
11. Termination
You may stop using the Services at any time. We may suspend or terminate your access to the Services if we believe you have violated these Terms, created risk for other users, or used the Services in a way that may harm MoniMoni, users, or third parties.
Because much of the App experience may be stored locally on your device, you are responsible for exporting or backing up any content you wish to keep.
12. Ownership
MoniMoni and its software, design, branding, interfaces, and related materials are owned by us or our licensors and are protected by intellectual property laws. Except for the limited right to use the Services under these Terms, we do not grant you any ownership or license to our intellectual property.
13. Warranty Disclaimer
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and error-free operation.
14. Limitation of Liability
To the fullest extent permitted by law, MoniMoni will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business, arising out of or related to your use of the Services.
15. Indemnity
You agree to defend, indemnify, and hold harmless MoniMoni from and against claims, liabilities, damages, losses, and expenses arising from your use of the Services, your User Content, your violation of these Terms, or your violation of any rights or laws.
